I understand that, but 'calls for new rules' doesn't mean that this is in effect as of August 8 of this year - unless I'm misreading here? Or are these expected to go in to effect by then?

I expect it to go into effect 8-8. But, that's just me. I don't know for certain.

Only things that get extra time are for applications for new products and some labeling requirements. But, the face to face thing needs no time to comply.

Description: On June 22, 2009, the President signed the Tobacco Control Act into law. In this rule, the Agency is extending FDA's "tobacco product" authorities in the FD&C Act to all other categories of products meeting the statutory definition of "tobacco product" in section 201(rr) of the FD&C Act, excluding accessories of deemed tobacco products. (Two options were presented in the NPRM. Under Option 1, all products meeting the definition of a "tobacco product," except accessories of newly deemed tobacco products, would be deemed. Option 2 was the same as Option 1, except a subset of cigars known as "premium cigars" would be excluded. After thorough review of the comments and the scientific evidence, FDA has concluded that Option 1 more effectively protects the public health and therefore has made that the scope of the final rule.) The rule also prohibits the sale of covered tobacco products to individuals under the age of 18 and prohibits the sale of covered tobacco products using the assistance of any retail-based electronic or mechanical device (such as a vending machine) except in facilities where the retailer ensures that no person younger than 18 years of age is present, or permitted to enter, at any time. The requirement that a retailer sell covered tobacco products in only a direct, face-to-face exchange without the assistance of electronic or mechanical devices is not intended to prevent the sale of tobacco products via the Internet, but the sale of covered tobacco products via any medium (including the Internet) must only be to persons 18 years of age or older.

(Comment 234) Some comments suggested that the deeming rule include a ban on Internet sales.
These comments asserted that manufacturers and retailers are not enforcing age verification effectively and that youth are able to purchase tobacco products when they are not in the physical presence of the seller.

Several comments also recommended that FDA require retailers to verify the age of purchasers of newly deemed tobacco products using methods similar to those found in the Prevent All Cigarette Trafficking (PACT) Act of 2009 (which ensures the collection of Federal, State, and local tobacco taxes on cigarettes and smokeless tobacco sold via the Internet or mail order sales).

Other comments opined that neither the PACT Act nor State laws have been effective in preventing youth access to tobacco products. (Response) Under this rule,
retailers may not sell covered tobacco products (through any medium) to individuals under 18 years of age. But even cigs are not actually banned from purchase online... As long as certain treaties are in fact upheld certain countries cannot have the post fucked with via customs into the US postal service.

I don't know what's to prevent the FDA from holding a meeting on, hopefully, the 12th of Never, and deciding vaping products, cigars, and others will join analogs in face to face sales only.

Also, given US regs and the TPD, how will the hardware manufacturers continue to provide what they already sell in the US? Will popular products, like Kanger sub tanks and tfv4's and their coils continue to be produced for vendors who we purchase from? Not saying they won't, but everyone involved is being forced to reassess and realign.

If some would prefer to move on to something less controversial, or are worried about providing for their families, I completely get that. Just hope it doesn't happen too much or too fast.

i do not think vaping gear will disappear. The point of these regs is simple - money. States and the Federal govt are losing tax revenue with the increase in vaping leading to the decrease in cig sales. SO they need to get vape stuff deemed as under FDA rule to tax it easier and make up for the loss. i would not be surprised if PM and others already have the paper work started on their cig alikes and are exploring how to get mods and juice lines bought and passed by the FDA so they can monopolize the market. This is all aboujt making more tax revenue and helping constituents, ie BT

They are not trying to get rid of vaping. just tax and control it so the right people make money of it not us average normal people

getting something online and it not being allowed to be sold online are two entirely different things.

but if you know a company that's.non native American selling cigarettes from and taxed on American soil link me to it.

I see a bright future for Evolve (and Chinese if they grasp it) in the "Electronics Hobby Kits".......information is not totally blocked yet. These American companies need to start breaking down components and coming up with NON tobacco items (Regulated room aeromamizing dispensers, which could use coils (ceramic or otherwise) for sale containing the basic configuration and software REPROGRAMABLE...leaving spare holes in circuit boards for "upgrades and different models" or create new regulated LED high-power handheld lights with same setup......maybe with 510 Screw on fragrance tanks and LED assemblies.................Make sure they have a 510 connector or way to "upgrade" to a larger fragrance tank or assembly.....

The let good old Yankee ingenuity and a few (few hell..thousands) instructions on numerous blogs as to how to "improve the performance of your item...............in other words a Swiss Knife flashlight and room deodorizer's ............................................Hacking is an America tradition!

What's got me more deeply concerned is the availability of liquid nicotine the one component not ...well.....economically fudgeable............the flavors are used in cooking, soft drinks, soaps, lotions and other items, if they try and go after those the FDA will be buried in Multi-Billion dollar lawsuits coming at them from OTHER entitled corporations (that also pay off politicians) like a swarm of angry Bumble Bees...

For those that know how to mix and those able and willing to learn to do so the e-juice's are reproducible for the most part.....

Maybe the Chinese will just start dumping un-assembled boards and assemblies on the American Market and let that "Yankee Ingenuity" take its course.

IN THE MEAN TIME.............I'M BUYING ALL THE GEAR I CAN AFFORD AND I'M GOING NEED TO LAST THE NEXT 15-20 YRS......

EDIT: Make the items capable of weaponization and the Miltary Industrial Complex will make it for us.....................and sell it all over the world to anybody....

Now this whole community knows what it feels like to be a gun owner. I'm sick of all these fellow vapers running around worried about cartoon labels and putting flappy bird on a mod. Worried about the negative attention it attracts. I don't give a shit about any of that. The only smart ones are the ones that filed suit against the FDA. You can't win this fight until you change the rules of engagement. You can't win fighting by their rules. All these advocacy people just don't get it. Wtf has CASAA and all those other groups done? They've been fighting this battle for years and have gotten their ass handed to them every time. You want to win the fight start by changing the rules and changing the people you vote for. Vote for candidates that are for less government innvolvment in YOUR LIFE.

Totally not true. Check out the people behind it. One Republican all the rest are Democrats. I posted a list in one of the threads possibly this one. I got it from Grimm Greens page. You see this is the problem. Every Democrat or Democrat sympathizer has the same line, "It's both parties". That's simply not true. How can you defeat an enemy if you refuse to define it?
