new eliquids and hardware still being released?

Have you guys notice alot of eliquid being produced here in the u.s.a are still being released? I thought no new flavors or juice lines were supposed to drop after August 8th?

They just had to be finished and announced I think. Maybe was released as a sale item later on. Just a guess though.

I'm not crazy, my mother had me tested.

it all depends on weather the manufacturer has started the pmta process or intends to shut down when fined

When you see new products being released after the 8th it's because they knew they wanted to release a product but couldn't get it out before the 8th. So they made sale to vendors on paper showing they had been sold when really they weren't released yet. They made a paper trail so they could prove they had it sold before the 8th. It's a way around the regs. You will see new products coming out for awhile still. They have technically been sold on paper before the 8th.

Oh the cigarette Co.s and Chinese are pushing out all kinds of new juices and Cigalike and pen vapes.. Saw a commercial last night for what looked like and old EVOD tank with a juice cartridge. You do realize the FDA BS was all about saving the cigarette tobacco industry. Politicians and regulator make low and regulation to benefit their supporters. Mom and pop Vape gear manufactures and juice makers are the target of the regulation, they didn't py-off enough politicians... The benefactors of the regulation are the BIGGER manufacturers and foreign makers. This is just another gift from the progressives to China.

Ya but what about alot of the new eliquid flavors or lines? I'm sure this can't be true for all of them. They are just continuing to pop up. You think they all had sold some to vendors before Aug 8 to create a paper trail? I think some people in the vape industry just dint care I mean hows the FD going to find out about every new flavor or little tank that's released it take at least some time.

Yeah your right. There are company's that don't care and are releasing new products regardless. I just know that a lot of products were sold pre 8th to create a paper trail. All the new sx mini mods like the q class mini and g class have been sold to vendors and also all of lost vapes new products like the skar, triade dna250, therion dna133 and dna167 have been sold pre 8th. Alot of company's covered there ass so they could release new shit and not worry.

Those that plan on bringing is as much cash as they can get their hands on then closing the doors as soon as they get caught play a part here.

I haven't noticed juice to much but mods, tanks etc I have. Nothing like before the 8th it was crazy. I have no idea how its works or if some laws are being stretched just alittle. Either way we are still having the chance to buy new products if we wish. Thats a plus but the whole situation going back to the 2008 law needs to be changed or lifted. But thats probably too much to ask for. Keep vaping

With no clear definition as to what constitutes an "ENDS", manufacturers are really free to produce, release, and sell new mods. In fact, all they would really need to do to have a strong legal claim of their device NOT being an "ENDS" is place a sticker on the device packaging in big, conspicuous letters stating, "This device is not intended to be used to vaporize liquids containing nicotine." Done. Seriously. This has been legally tested already in other cases that can't be mentioned here involving devices that can't be mentioned here. The fine point is that it CAN be used for other purposes, and therefore can not be illegal to sell under the "deeming regs". As long as your shop isn't selling the software (eliquid) for the hardware, there's really not much the FDA can do, since there's no correlation, then, from the standpoint of the seller who, in turn, has no control over to what use the buyer puts the device. I've been saying this for months now. Watch. Online retailers will eventually move to juice OR hardware, but not both.

I'm sure we'll see a test case, eventually. Probably against someone big like Joyetech or Kangertech.

Juice is a different story BUT, there're loopholes there as well. Juice makers now could EASILY turn to premixed flavor vials of your favorite flavor and release it as a flavor concentrate. You would then buy that concentrate and add it to a specified amount of your own homemade base. Or you'd buy 0 nic exclusively and add your own, purchased elsewhere, at home. So the only companies absolutely needing to register their products will really be the nicotine suppliers. AND, as these are already large labs who've already done the assays and legwork, submission will be easy peasy. At worst, we're looking at (domestically anyway) one single concentration, probably 10%/100mg, being available. If nothing changes, the future of vaping, at worst, will be more like mixing up a quart of KoolAid from premade vials of flavor and nic (probably in 3mg ampules), and bottles of unflavored PG/VG blends.

And let's not forget that the FDA is NOT a global entity. Flavors and devices will continue to be produced and sold outside of the US as if nothing happened.

Thanks. Of course, no one wants to be the FDAs test case. So I can readily understand why and if US retailers and manufacturers don't take the risks.
