No surprise here. During their first year in business in 2015, when the Deeming was still a proposal, Juul publicly stated that they intended to submit to the PMTA process.

At this point they may well be the only vapor products company with the resources to submit applications that the FDA won't be able to reject out-of-hand as incomplete. I would suppose this one of the main reasons they partnered with Altria, which is one of only two companies in the world that has a staff with a proven track record of successfully navigating the PMTA process.

If the deadline stands where it is now at May 11, 2020, Juul may very well end up with something resembling a monopoly on legal vapor products in the USA.

True monopolies virtually never arise naturally; they are almost always the result of some kind of government intervention in the market.

That said, I don't blame Juul for doing what's best for Juul. They're a business, not a charity. I blame government (specifically the FDA) for creating a byzantine process that's almost certain to exclude rest of the industry from the market.

And even if the FDA succeeds in their quest I predict I will still be able to get Chinese MOD's, Coils and Tanks shipped to me marked as Steel Tubes or Electronic Parts. Ever read your customs declarations these days?

I agree, you probably will be able to get hardware that way.

Ever read your customs declarations these days?
No, because I have never bought vape hardware directly from China.

Yes, I'm well aware that many Chinese businesses are less than scrupulously honest. ;)

Well you can apply subjective to that and not unscrupulous because I bought a bunch of glass tanks for an Atomizer described as Glass Tubes. But they were 100% Accurate with the Customs declaration why must it say for vaping atomizers? They are only glass tubes.

I'm thinking back to the heady days of clones, when they wouldn't just copy an original device, but also put the original manufacturer's name and logo on the clone, and print "Made in [the original maker's country]" on the packaging.

I still see this kind of thing on a daily basis in my own (not vape-related) business, where it's not just trademark infringement and misrepresenting the country of origin, but also blatant copyright infringement.

But yeah, if you're ordering what amounts to glass tubes, it's not particularly dishonest to declare them as glass tubes. Now if you're ordering a complete atty or mod.....

Sure I would want Authentic but if the FDA has it's way the only Authentic Devices available will be made in China. They don't usually clone or copy their own shit.

They're 75% of the market for vapor products in convenience stores, but that's by far not representative of the total market for vapor products, which is much harder to track because it consist of thousands of small, independent shops, on-line vendors, and even overseas vendors.
