I happened to check out Hon Lik's patent on the first modern day cigilike:

    https://patents.google.com/patent/US20060196518A1/en

I also came across these other interesting patents from the late 80's:

    Simulated smoking device

    https://patents.google.com/patent/US4945931A/en

"A smoking device for releasing an aerosol into the mouth of a smoker comprises in combination, a chamber into which a mixture of air and a liquid aerosol precursor is introduced"

    https://patents.google.com/patent/US4848374A/en

    Aerosol device simulating a smoking

    https://patents.google.com/patent/US4945929A/en

This list wouldn't be complete without the first known smokeless non-tobacco cigarette from Herbert A. Gilbert in 1963:

    https://patents.google.com/patent/US3200819A/en

If you scroll to the bottom of each patent in the citations there is all sorts of interesting similar shit to check out.

I wonder if these would be approved for use by the FDA!

There is one cigalike type vape device that is grandfathered in under the Feb 2007 grandfather date. However I think it is no longer manufactured.
however I think functionally identical devices could be approved under the equivalency provisions and not have to go thru full PMTA.

Since when has something like patents and copyrights mattered to the Chinese?
they did not sign on to our patent and copyright laws did they?
