STUDY FINDS 98% OF FDA RULES UNCONSTITUTIONAL

The entire FedGov generally doesn't give a shit about the Constitution. The Constitution grants certain enumerated powers to the FedGov has, and explicitly reserves everything else to the States, and the people. Yet most of what the FedGov does these days is nowhere to be found in the enumerated powers granted to the FedGov, and it's been that way for roughly 100 years now.

I continue to chuckle at the "shock" of folks discovering the feds - or states - or even local gov - decides they are Special.

All started with George Washington and the whiskey rebellion.
Who gathered more troops to enforce a federal tax than had gathered for any battle in the revolutionary War.

So it was pretty much always this way.
