Except that Michael Eriksen has been repeatedly informed (by me and others) that FDA’s Deeming Regulation protects cigarettes and threatens public health because it bans the sale of >99.9% of nicotine vapor products to all adult vapers and smokers in the US 24 months after issuance of the Final Rule (but doesn’t ban any cigarettes), which would prompt several million vapers to either switch back to far more harmful cigarettes, or to buy totally unregulated vapor products from FDA’s newly created black markets.

Eriksen is also aware the FDA Deeming Rule would do very little if anything to protect children since there is no evidence vapor products have ever created nicotine dependence in any nonsmoker (anywhere in the world), and because the 2015 NIDA funded MTF survey found that <20% of teens who used vapor products reported vaping nicotine. And yet, FDA’s Deeming Regulation does NOT regulate the sale of no-nicotine vapor products used by most teens (and won’t even ban their sales to minors).

Also in contrast to Eriksen’s claims, the growing mountain of scientific and empirical evidence indicate that nicotine vapor products (aka e-cigarettes):- are 99% (+/-1%) less hazardous than cigarettes,- are virtually all (i.e. >99%) consumed by smokers and by ex-smokers who switched to vaping,- have replaced more than 4 Billion packs of cigarettes worldwide in the past eight years,- have helped several million smokers quit smoking, and have helped several million more smokers sharply reduce their cigarette consumption,- are more effective for smoking cessation than FDA approved nicotine gums, lozenges and patches (which have a 95% failure rate),
- pose fewer pyschotic risks than FDA approved Verenicline (Chantix),- have never been found to be a gateway to cigarette smoking for anyone,
- emit trace levels of nontoxic aerosol that poses no harm to nonusers, and- have further denormalized cigarette smoking (as youth and adult smoking rates and cigarette consumption have declined to record lows since 2010 when vapor sales began to skyrocket).

Smokefree Pennsylvania submitted more than 100 pages of comments to the FDA urging the agency to rescind its proposed Deeming Regulation at: http://www.regulations.gov/#!documentDetail;D=FDA-2014-N-0189-80846because it protects cigarettes and threatens the lives of all vapers and smokers in the US by banning >99.9% of nicotine vapor products.

Our comments analyzed virtually all scientific studies on vapor products, and exposed hundreds of false and misleading fear mongering claims about vapor products by Obama’s DHHS, their funding recipients, and by Big Pharma funded groups (that tout drugs as the only effective way to quit smoking).
