Just wondering how EVOLV are going to be effected by the regulation.

Are the DNA chips themselves without a mod considered a tobacco product?

Are they going to be able to export them to China?

Yep chips and software are specifically mentioned in the Deeming Regs.
All PMTA approved vaping stuff must be labelled NOT FOR EXPORT.

I figure they will move from the USA.
But unless FDA approved their devices/chipsets will not be allowed to be sold here in the future.

Technically software updates for existing vape devices are now against the law.
They are a new product introduced after 8-8-2016.

But, in reality the boards are power management and could be 'sold' in other ways. Not saying that's a route they would try. The boards used by prorape are also USA made. I guess we will all be waiting to see what they do. I haven't noticed anything on their forum yet

In reality I think its too soon to really say. I know the okl chips are also used in Led applications and in some robotics, as their primary usage. Those were repurposed for vaping, so they should be safe from the claws of 'ABC gubbamint'

roger that, I have a few boards stashed, the nice thing about the evolv boards is that fuse. Theoretically it should protect the board itself from damage. someone with a little bit of knowledge and minimal experience could change one and keep the board running for a good while.
the company itself is in it for the long haul. if they can weather the storm and afford the governments pound of flesh is another issue.

- the battery safety thing? what is that youre referring to? first ive heard it mentioned.

It requires the FDA to oversee battery/MOD safety. Battery in the Deeming stuff means MOD.

Selling DNA chips as fancy 200W flashlight controllers is a bit of a stretch, especially since everybody already know EVOLV and what their chips are exclusively used for.

yes true... but rebranding the boards and selling them flat as "power control" boards and then fencing them through a robotics distributor next to an Arduino is "in theory" a possibility should they not be able to or decide against trying to work with government.
I'm just putting out plausible alternatives.
by no means am I suggesting anything other than desperate work arounds should we go back to the days of blue foam and toaster rape.

Well, I prefer the temperature of my light bulb to remain constant. I swear it's easier that way to find the dog outside at night.
Ahh your light bulb temp is probably around 3000K if it is incandescent.
I like the 6000K LED and CFL's beytter though.

Does the DNA do Tungsten?

I figure more like fixed wattage and temperature.
but maybe variable wattage with fixed temp.

I am thinking the cartridge will tell the non replaceable battery mod how much wattage and such with a chip.

All guesses right now though.

I do figure that one requirement for approval will be that the user cannot vary things to impact the temperature or wattage and thereby impact the composition of the vapor.

Welcome to the Brave New World. Boards and chipsets and software need only ONE thing to circumvent the regs, a single disclaimer:

This product is neither manufactured nor intended for use in electronic cigarettes or personal vaporizers.

Done. Evolv can make whatever they want. They can sell it to whomever they want, preferably an electronics distribution chain with volume discounting that distributes to companies who make other things (like flashlights) besides ecigs. To be extra safe, the board would have a slider or two plates or jumper, one for pulse and one for on/off, for use in those flashlights. There really is no way that the FDA can deem a circuit board specifically manufactured for any use other than in PVs under the deeming regs.

<edit> Flashlight is but one readily used example. Toaster over could be another. Portable personal heater/glove warmer, and so on. Just because the FDA sees only a single application for a device does not mean that it can't have multiple applications. And, if I were Evolv, I would manufacture one of those, with the same boards and software, and say, "see?" THIS is our intended use, we have no control over what other manufacturers of consumer products do with our boards, but this is our intent.

so like a battery(mod) with a replaceable cartridge and the cartridge tells the mod how high to fire?
I really hope evolve fights to help keep themselves in modders boards. I cant see a cigalike darwin

Agreed, but this is primarily the result of a politically charged discussion on labor, labor unions, and fair compensation.
