GameStop Being Sued by Former Employee Over New York Labor Laws

GameStop is being sued by a former employee who said workers should be recognised as manual laborers.


As reported by Polygon, Trevon Mack worked for GameStop from 2016 to 2020 and filed a lawsuit in New York's eastern district on May 18 this year, claiming the retailer is in violation of New York Labor Law.

Under section 191, workers classified as manual labourers must be paid every week, but GameStop pays its employees every two weeks.


The main point of contention will likely be over GameStop employees being acknowledged as manual laborers or not.

New York defines these as "a mechanic, workingman, or laborer," who does physical labour for more than 25% of their working day. New York's Department of Labor's definition is also ambiguous, literally stating the definition can "include countless physical tasks".


Mack's lawsuit claims that GameStop employees therefore do qualify as manual labourers, saying that more than 25% of their job requires them to do manual labor including the organisation of stockrooms, moving packages, and standing during long shifts.

Beyond the lawsuit, GameStop has been struggling in recent years due to declines in the physical gaming space, perhaps prompting its latest venture into the metaverse with the creation of its NFT marketplace.
