This time its Vaporcrypt.

This isn't as vague a reason as the others. I took a look at Vaporcrypts website and they are selling full out Hana Clones for $120.99 - logo and all.

I have a feeling they don't know they are being sued yet - because its still being sold on their site.
Wouldn't suck to find out your being sued because Vaporjoe told you so?

I still think it could have been avoided with a simple phone call.

Hmm.. I'm surprised they didn't get a cease and desist letter. I was always told that the proper way to fight trademark or patent infringement is to do a test buy, then send a cease and desist, and then (if the violation continues) file a lawsuit.

When family tried to go after someone for patent infringement, they were told by attorney that they had to do a test buy and a cease and desist before they could sue. When Philip Morris got upset with me for trademark infringement, they did the same thing (test buy and then cease and desist).

Perhaps it's because of the tremendous expense involved in filing the lawsuit that a C&D is usually sent first?

Not to mention the fact that a C&D is much more civilized
