here is what confuses me
it says anything that is substanially equivalent to a produced marketed in teh US as of 2007.

Granted we only basically hand cartomizers and 510 style batteries then, could the argument not be made that EVERYTHING we have now is substantially equivalent. It still just a coil, wick, juice and battery?

That would one of the things the Vaping Community's crowdfunded best team of lawyers in the universe would be use for.
That is if these super lawyers let the FDA even get that far.
