Yep sucks but thing is unless I have missed another delay the PMTA enforcement begins in around 9 weeks which will kind make this a moot point.
afik no vape product is PMTA approved yet.
A handful with pending apps can still be sold for a while. Pods and cigalikes I think.
I do not know of any other vape products including bottled juice that has PMTA apps accepted.

PLEASE tell me I am wrong though.

Is it applied or approved? Not a vape product anyway, really.
I thought a couple of the BT owned pods and such had apps accepted?

PMTA is for all tobacco products traditional and vape not on the US market prior to Feb 2007? I think the grandfather date is.
It also being for traditional tobacco products is the only reason enforcement has been delayed as long as it has. It also hits some expensive cigars and such as well.

It's been applied but not approved yet I think. I can't find any hard facts. As far as i could find nothing has been approved but i might be wrong. The facts are pretty jumbled.

yep hard to find out anything for certain but last I found only maybe 15 or so total filed vape PMTA apps that were not rejected initially.
And I have heard nothing about any mix and match vape hardware or bottled juice being applied for...
I suspect that open vape systems will not be approved per the PMTA requirements docs I perused..
nor any devices that will allow one to run an atomizer too hot and give off inconsistent results. ie variable wattage...

Also there is a new UL spec for vape devices...

I don't. And most of the time, I use the kiosk, anyway. When I do hit the counter, they don't normally ask for a lot of details.

Fuck to the No!!! They aren't.
They are just going to push that cost on to us.

Selling to one another as individuals this would have no real impact but for the vendors....

As I said before kind of a moot point if the PMTA enforcement kicks in in around 9 weeks as per current schedule.

There was a lawsuit and a new agreed upon of enforcement May 9? Which got delayed to September 6?
Due to the Corona virus and different FDA focus.
The new date had to be agreed upon by the courts.
Not sure on the actual days of the month...
I agree be aware of incomplete / incorrect information.

BTW fake news is a highly political phrase.

Also I am not aware of any further enforcement delay past Sept. But considering how the corona virus is going it may well be delayed yet again.

If it weren't for some super rich ny moms who downed their kits in cash to only find that they spent it on vaping I doubt we would even be having this conversation... Yet.
But the deeming regs and the PMTA process were settled on and enacted long before the teen vaping problem.

This is true.
But they hadn't been able to ban flavors or enact crazy online bans in at the state level beforehand.

Now there's a goofy patchwork of regs from state to state.

If they hadn't kicked the can down the road to begin with we wouldn't have had any of these goofy state laws that will never go away.

Some states allow flavors some don't. Some tax, some don't. Some have online bans etc...

None of that world exist without the incompetence of the FDA

I cannot disagree with that at all.

Many/most state laws do take into account any FDA approved flavors and such. Exempting them from their bans.

But since NONE are FDA approved yet... Even tobacco flavor is not approved, just delayed enforcement...

Taxes are another issue but since nothing is approved for sale do not look for them to collect much taxes after PMTA enforcement kicks in.

The link in the screen shot you posted states that the lawsuit the FDA lost requires the FDA to move back the PMTA deadline to May 11, 2020, nullifying the Aug. 8, 2022 deadline the FDA had previously set. The same judge who ruled against the FDA moved the May 2020 PMTA deadline to September 9, 2020 due to disruptions caused by Covid 19.

Any vape related product on the market without an PMTA (large numbers of PMTAs have been rejected by the FDA) will be illegal to sell period

Additionally, the FDA had already been notifying retailers they must remove flavored juices, etc from their shelves - a simple google search will show multiple examples of it on the FDA website
