On May 4, 2015, Mitch Zeller, Director of the FDA’s Center for Tobacco Products, delivered a Keynote Address to an audience of e-cigarette/vaping industry leaders and stakeholders. His remarks included reference to youth, flavors, and marketing and as he looked to the future, he asked the following questions:

As members of the electronic cigarette and vaping industry, we believe that responsible conduct is an obligation of the industry. In keeping with this idea, we agree to the following principles:

- Will the debate continue to be fueled by concerns over flavors and industry behavior?
- What has to change for the debate to be focused primarily on public health considerations with room for an honest dialogue on tobacco use and issues such as relative risk?
- What role will industry play?
- Is the debate going to be centered on the behavior of the industry?
- What will it take to change the debate?

As members of the electronic cigarette and vaping industry, we believe that responsible conduct is an obligation of the industry. In keeping with this idea, we agree to the following principles:
Statement of Principles:
- Youth Access: We don’t sell to persons under the age of 18.
- Child Resistant Packaging: We agree that all bottled e-liquid is required to have child resistant and tamper evident packaging.
- Marketing Materials: We agree that marketing imagery, nomenclature, and product naming must not target persons under the legal age of purchase.
- Online Access: We believe that verified adult access to these products online is entirely acceptable.
- Age Verification Online: We are committed to the deployment of robust third party age verification for online purchases across the entire industry.
- Age Verification (retail): We agree that all consumers who appear to be under the age of 27 should be required to verify their age with valid photo identification before purchase.
- Age Verification (training): We agree that all employees at all retail locations should be trained to actively verify age before purchase.
- Flavoring: We believe that flavors play an important role in providing adult smokers an appealing and satisfying alternative to combustible tobacco products.
- Flavors Target Adults Only: We are committed to the development of a sensible protocol to ensure flavors used are not being used to target children.
- Open Invitation: We encourage and call on all members and stakeholders of the electronic cigarette and vaping industry to show support by signing, adhering to, and upholding these principles.
