I was on steam engine the other day and one of the ads for an online juice vendor said something like "Worried about FDA deeming regs? Don't worry, we'll always be here for you! We are prepared to be compliant and remain open"
Out of curiosity I clicked on the ad. Before getting to the main page a huge popup jumps out saying "sorry, we can no longer sell e juice to clients in Indiana"
A vape site in Utah stated it cannot sell any product through the mail to addresses in Utah.
Arkansas has laws very repressive towards online vendors. Another member here on VU who lives there said about half the online vendors are refusing to sell to him.
Calif. and Hawaii have raised the vaping age to 21.
Texas has stringent ID laws that also apply to online sales. I tried to buy a mod from a TX site awhile back - they wanted a copy of my ID PLUS the last four digits of my SSN for a simple online sale of one mod. I told them to pound sand.
The new Pennsylvania tax on vape gear (40%) goes after vapers who buy online to avoid the tax and places hefty fines similar to those who get caught with illegal drugs such as ******. It goes into effect Oct. 1.
My home state of Alaska had a bill pending all year that would have put a 100% tax on all vape products - juice, mods, atomizers, drip tips, coils, cigalikes, you name it, they covered it. (it is still pending until the next legislative session) One of the boroughs here already has a 55% tax on the wholesale price on all vape products.
The Jenkins Act (also known as P.A.C.T.) will likely be slightly modified to include vape gear because the deeming regs. The Jenkins Act is the mechanism used by states to collect tobacco tax on cigarettes bought in states or from Indian reservations with lower tax than the buyers home state. It is enforced by the ATF and has teeth. I know this because I have friends who received tax bills from the state when they bought tobacco online.
I'm probably missing numerous examples of vape-repressive laws either in effect or pending on the state level all over the U.S.
