I have bought batteries from them many times but didn't notice the warning "do not use in e-cig or vape"... is this new? I assume it's just for legal reasons. I want to order some flat top 18650 batteries (same ones I have ordered before)

Purely legal, they risk regulatory issues if they sell them for vaping purposes, because then the batteries themselves are classified as tobacco products.
