It's almost obvious that the fumes from lighting a cigarette and exhaling from a vape are dramatically different. As a native New Yorker I am very pleased with this ruling but I know this is not the case in other states.
I think these regulations and word play are just another way to deter smokers from making the switch. Who is the one losing when it comes to vaping? Big Tabacco! I read an interview today on the Wall Street Journal and Jennifer Maloney, journalist of WSJ, stated in an interview with National Public Radio "Despite a sharp decrease of smokers in the U.S., tobacco companies are more profitable than ever." Reading that was so disappointing but solidified my theories.
