Curious how long til big tobacco dumps millions into changing the classification of a tobacco product to also include this?

They managed to get a patent in before 08/08/2016
Supposedly the FDA has no authority over it.
But, If a the FDA can deem a little blue screwdriver and bag of orings as a "tobacco product" then they pretty much have free reign to deem anything they damn well please as a tobacco product.
