New York State Study Allows E-Cigarette Purchases Using Facial Recognition or Fingerprint Scanning to Verify Age

On April 26, according to the New York Post, the New York State Senate is advancing proposed legislation that would allow bars and restaurants to use facial recognition or fingerprint scanners to verify the age of customers before allowing them to buy alcohol, Tobacco or electronic cigarettes.
"This is the new frontier in age verification," said state Sen. James Scophies, who sponsored the biometrics bill. "It does advance the benefit of convenience."
Skoufis envisions bars and restaurants that could scan customers' fingerprints, faces or retinas to avoid the hassle of showing ID on future returns. The proposed legislation would require all data to be encrypted and prohibit businesses from selling biometric data to third parties.
"No one is forced to use this technology, but they have a choice," Skoufis said.
Age verification based on facial recognition technology is common in some places but not yet popular in Western countries, and critics have raised concerns about consumer privacy.

In the United States, it is illegal to sell e-cigarettes to anyone under the age of 21. In order to enforce this age limit, retailers are required to check the identification of anyone who appears to be under the age of 27 before selling them e-cigarettes. This is typically done by checking a government-issued identification card, such as a driver's license or passport. Facial recognition or fingerprint scanning technology is not currently being used to verify age for e-cigarette purchases.
