Not finding the link there to the actual case docs, looks like they've attached the wrong file. I'm curious to read more because I suspect this is fallout from the Hana debacle some time ago - no other e-cig copyright complaints I'm even aware of...

selling clones is illegal huh
It's going to depend on whether the makers of the originals can show that they hold established patents or trademarks for their products. I'd really like to know what exactly he sold clones of.

It just seems like it would be really hard to make the case that selling clones is illegal. Not too many vape makers hold patents, though many hold trademarks and copyrights.

I'm assuming that guy was selling clones as originals.

That would be fraud.

This guy was convicted of "trafficking counterfeit goods" and the matter was investigated and brought forward by Immigration and Customs Enforcement, Homeland Security Investigations.

While ICE is a federal agency with federal juristiction, they more commonly investigate importation offences, as opposed to fraud.

A suspicious person might wonder why ecigs are being given federal attention...

Counterfeiting is illegal, even if some call it 'clones'. DHS investigates counterfeiting as money laundering through counterfeiting has been known to support terror organizations...

Where these dry tobacco vaporizers? Or where they actual ecigs?
I know a lot of the major manufactures of dry tobacco vaporizers have patented designs as well as logos.

Hogwash. Clones are not counterfeits.
It's only counterfeiting if the item is patented, trademarked, or copyrighted and the counterfeiter tries to pass it off as genuine.
Probably what the slob was screaming as he was taken away in handcuffs...
